so we have been goin thru this custody battle, well judge is changing Aiden's name to his last name its not that big of deal i know but, he is takin him everyother weekend to his house which its nasty dirty and i know cuz when we were dating i cleaned half of it and it took me 3 days to clean the living room! and 2 days to do dishes! nd that was only stoppin to eat and go to restroom, it took me 9 hours to clean the bathroom! u cant imagine how dirty this place was he has 3 room mates, one of them (jesse)was and is a good friend with me and him but he is never there he works all the time... well anyways kevin (fob) does drugs and drinks in the house unless jesse is there cuz he doesnt approve of the drugs, nd would kick him out...i know if i told him nd he kicked him out he would tell kevin i told him, nd kevin would try to break in again or slash our tires again nd the cops in this town are worthless the last time kevin did those things the cops said o well we have no proof nd didnt do a nythin...

then a week ago he got arrested again with his 2nd DUI, and got a felony nd our lawyer has been tryin to call the local court house to find out details so that we can use that against him in the custody battle but they wont relase the information. kevin wont tell me if its true and idk what im gonna do...
it scares me that he wont be responsible when aiden is there i have run out of legal options to do to prevent things happening to my baby... his friends that are ALWAYS there drink nd get rowdy nd start fightin.... idk what to do

Sorry you're having problems courts only deal in facts, not rumours or hearsay. Is there anyway you can PROVE he does these things in his home? If you can a judge won't let him near him except through supervised access. Not sure if the law in US is the same as here but I would would assume in this case it will be at least similar

The judge is changing his name?? I didn't even know they DID that. I really hope everything works out alright for you and your baby. Bring in proof. They can only go by proof.

i dnt have any actual proof other than seein him do it when we were datin ndi didnt kno what they were doin till after we broke up nd asked my mom bout it ( i was a sheltered child) lol

You can call social services on him and they will check the housing situation. If he was convicted of a DUI- that would cause him to have supervised visitation only, if hes convicted, if you feel like your child is in danger in his home or care you can file an emergency protection order at your local police office. Do you have a lawyer?

I cant understand how they can change his name...i thought u had to agree to that... id try to get some sort of evidence xxx

my child isn't born yet, but I'm worried about the same thing when she/he arrives in September.

My question was how could they change the babys name? Legally, a baby can have a different last name than the father and the father still has to pay child support.. My baby will have my last name and not his.. it wont have his because I know he won't be there for the child..

about the housing situation: call DFCS and report that the house is dangerous for a baby to live in. they will search the house up and down: if its nasty, he can still have visitation, but it wont be at that house: it will be in front of a social worker! so thats great news! then you wont have to worry about the baby getting hurt, or better yet ingesting drugs!!!

I agree, get social services involved. Can you get one of the roommates to be witness to FOB`s drug use? That would be a definite cancellation of visitation rights.

I`ve had a good friend (the father) go through a custody battle - it can get really nasty *hugs* keep your support circle close and yes, keep papers of everything! document dates, visits, etc. The facts are on your side, just need to get them together.
