Custody rights


Does anyone know what happens with custody when the parents don't live in the same place? Adam and I are 8 hours apart. Surely no judge in their right mind would allow him to take the baby 8 hours away for days at a time? He would have to come here or I would have to go there, right?

I'm just concerned, I don't want him to come back later on and decide that he wants the baby to visit him. That would be so scary wouldn't it? I mean, the baby would have NO idea who he is, it'd be a total shock, she'd be ripped away from her mom to go with total strangers in a place that she had never been before, visiting people she's never seen before, for days on end? They wouldn't do that, right???

Well,he won't be on the birth certificate.So he will have NO parental rights.

But if he later wants contact with her and takes you to court,prves paternity,the court might just give him visitation rights unfortunatly.
But probably not if he is still 8 hours away and with his history (i.e. his absolute no interest in her despite you trying like crazy to include him!)

So I have no idea,didn't you say you plan on contacting a lawyer for this?
Maybe he'll give you a permanant solution how to get him OUT of your life for good!

As long as your breast feeding he cant take her away but technically unless he is deemed 'unfit' for parenting, after you finished breast feeding (10months is the average) he is entitled to caring ...

I mentioned this to you before Rae. My mom lives in Alberta and when OH and I were separated for the 5 months when my daughter was 18 months and my son was about to be born, I was told that what can potentially happen is the courts could order me to move back to BC if I in fact moved to Alberta. Once again, father's equal rights playing a part of this.

This may or may not happen in your situation.

Of course, when the baby is a newborn the courts cannot do so much but later on and if Adam did come around and start being a fit father, the courts could go any way on this.

I really suggest that you get some legal advice.

i have to agree with leeanne, you would best to seek legal advice so you know both yours and his rights
