Going back 2 work?? question!


The other day i was talking to another new mum, she wasnt planing on going back to work until she was told she would have 2 pay back all her maternity pay if she didnt...even if its just 1 day a week!
It confussed me slightly because i thort as long as u tell your boss before your leave is over that u wont b returnin 2 work then its fine.
has anyone else been told this??

I was under the impression that if your employer pays you additional maternity pay, then you might have to pay this back if you don't go back to work but it would depend on the terms of your contract and the maternity policy. As far as I know, the state pay doesn't need to be paid back if you don't return - I guess if you've already built up your work credits, why should you lose out if you decide to be a SAHM? I'm not totally sure though, would be worth checking out...

It's just additional maternity pay that would need to be paid back. SMP is yours to keep regardless as to whether you return to work. I work for the NHS and get a really good maternity package made up of additional maternity pay, if i wasn't to go back to work i would be expected to pay back the additional pay i received. However after 3 months returning back to work i would be able to leave and not have to re pay the money. As far as i'm aware as long as you return to work it doesn't matter how many days or hours you do it's still classed as returning and you wouldn't have to re pay. Hope that makes sense, obviously some other employers may have different clauses. x

She must have had extra money on top of SMP and it was in her contract that she would have to pay it back if she didnt return xxx

yeah as the girls have said.. you only pay back any extra money your employer has paid you whilst on mat leave.... but you dont pay SMP back!

We get a top up as well...and we have to stay a specific amount of time otherwise we'd have to pay it back...can't remember what it is as I'm not going anywhere! lol

Thank you guys thats made it a bit clearer 4 me! its jus im finishin nxt week and wanted 2 get it sorted b4 then...i had a meetin wiv my boss 2day aswell!

I have to go back for 3 months or pay back the extra 'topped up' bit that my employer gives me. As they above all said it depends on the terms of your contract sop check it out carefully before you sign anything.... you'd never guess I'm married to an employment law barrister would you !!

I think it depends on the employer and whats stated in the contract as at one of my previous jobs the girl I sat next to had 6 months off full pay then a month before she was due to return handed her notice in and she didn't have to pay anything back (this was a few years ago though)
