This is probably in the wrong place...


..but I'm in third tri and I figured anyone going on maternity leave would know about this and would also be in Tri 3..


The company i work for are going bust.

I am being made redundant as of next Friday.

After giving my MAT B1 form to my employer many weeks ago, and my employer having my written statement of pregnancy for many months, It was only today when I asked my boss ina meeting about maternity pay etc that I was told I am not entitled to it through the company.

I have been told differently.

I was told that in order to qualify, I would have to have been working for the company for at least 26 weeks by the 15th week before baby is due. Well I started working there on 25th June 2008, and I am now exactly 29 weeks pregnant. I work out that I am entitled.

Anyone else want to challenge me? Lol

Is this right??

I think you should be getting it, might be best to ring up and check?

Who is eligible?To qualify for Statutory Maternity Pay you must have been:

employed by the same employer continuously (some breaks do not interrupt continuous employment) for at least 26 weeks into the 15th week before the week your baby is due; and
earning an average of at least £90 a week (before tax)

If you believe your employer's decision not to pay SMP to you is wrong, or that you are not getting the correct amount, then you should contact HM Revenue and Customs (Statutory Payments Disputes team) on 0191 225 5221. They make decisions on SMP where the employer and employee cannot agree.

it sounds like yu are are entitled and i reckon you should see citizens advice about it make sure you are getting all the rights you rightfully deserve.....

I am pretty sure that the company claim the money back for your maternity (i could be wrong though) check out the link its got a lot of stuff about mat pay rights.

Ooo tough one! I am also from your end - swindon! Hehe. Its prob different with me as my contract is actually ending as from 30 Apr so I am entitled to SMP but not entitled to any pay through the company, but I'm not sure its different if you are being made redundant I would have thought you had more rights!
