Can they do this??


my boyfriend started a new job about 2 month ago and yesterday he decided to go and see the bosses about which two weeks he wanted off and he said that he'd meet me after he'd seen them so i went and met him and his bosses have turned around to him and said he cant have any time off because he didnt tell them at the interview that i was pregnant. can they do this im so worried now that he's not going to be at the birth and that im going to have no support from him for first couple of week if he cant have any time off ??

anyone got any idea if they can do this ??

he does have to be with the company a certain amount of time before baby is due ... but not sur ehow long it is!! I would seek citizens advice hun!!!

Employment Law is not my cup of tea, but I dont think he is required to tell them. He is only required to tell them about any pre-existing conditions affecting himself. NOT you.

I think you have to have been employed for 26weeks before the 15th week before baby is due. If he has been there only 2months i dont think thats long enough before the 15th week baby is due.

aw, I hope you sort it out hun. I know how you feel though - I have only been in my current job for 2 months (was 12 weeks pregnant when they took me on permanently) and I am not entitled to anything at all. Basically am just losing my job as I have to take a leave of unpaid absence and they can't guarantee I'll have a job to come back to. You think you have all these rights but if you haven't been with the company a certain length of time it seems you have nothing!

So what happens to employees who don't know their OHs are pregnant until late on in the pregnancy?

I'd contact Citizens Advice and ask them.

Poor Kaz- what a bummer!
You are so right - timing is everything.
In Canada, we get a full year of EI (employment insurance) for mat leave, as long as we have been employed for a full 52 weeks before that. I don't believe it has to be at the same job, it just has to be 52 consecutive weeks. EI certainly isn't living a life of luxury, but it's fine if you've budgeted and your partner has a good job. I do not know how a single parent would manage, though.
I also don't think it's fair that you basically get punished if you've just started a new job and will be due to have baby before a full year of working.
