I'd contact Citizens Advice and ask them. | I think it's more that he hasn't been there for long enough to qualify for paternity leave (although why telling them at the interview would have made a difference I don't know...strange thing to say). At 20 weeks pregnant you don't even have to have told your employers yet for maternity leave, so I don't think that's what they meant.
Is there any way he can take holiday at the time bubs is due instead? x |

I'm Currently Feeling: | I know that unless he's been with the company he is not entitled to any time off. My OH stats a new job on 28th of this month and when he got his contract he asked about it and they are giving him a week unpaid which tbf is good considering they dont have to let him have anything. Could he maybe ask for unpaid leave or take it from his holiday entitlement.
Also my OH paternity leave is going to start from when I leave the hospital with the baby (becuase he only has a week and if for any reason I have to have a section the last thing I want is him ciming in at visiting times to say hi for 5 days then going back to work when I get home!) surely if he is in work and says my mrs has gone into labour i need to go they can't say no???
I hope you can sort something xxx
ps http://www.direct.gov.uk/en/Employme...lace/index.htm try that is the governments website xxx |

When I had Faith, my OH only had 2 days off and that was that! He was obviously off the day I had Faith and then I was in hospital a couple of days so he went to work as normal (his work was nxt to the hospital at the time so he could pop in) then he had 2 days with me once I was discharged and that was it, back to work. Illegal I know but he worked for a family business that did what they liked and there wasn't a damn thing we could do. Needless to say he isn't there anymore so fingers crossed he gets the 2 weeks off this time but again it's another family business....... |

I'm Currently Feeling: | My OH started a new job last week. He is not entitled to paternity leave as statutory demands him to have been in that position with that co for 6 months. He is going to have to take annual leave. Can your man do that? |

They aren't optional.
I guess you have to weigh the hassle of fighting the owners with just accepting it and trying to find something else. My only thing is that when people get away with ignoring labour laws, then they'll do it again and again to someone else after you, you know?
It's hard though. You really have to choose your battles. |

I'm Currently Feeling: | Ummm... here he would have had to tell them upon hiring that he would be unavailable for 2weeks, and he would not have had to give a reason why, just that he had prior commitments.
Otherwise, most companies require you to work a certain amount of time/hours before you are entitled to holidays or time off.
In Ontario for Maternity leave, you must give the employer 4 weeks notice. And if it is a job you are planning to return to, depending on which union you are with, they all require you to work a certain amount of time before they will let you off on leave to return.
For my work, you have to be with the company for 13 weeks before they will offer you maternity leave... Some other companies are a full year. |

I'm Currently Feeling: | Yeah i think they can. As others have posted, you need to be in a job for a certain time before any time off, particulalrly paternity leave!
Why didn't he tell them you were pregnant?? I suppose they didn't ask, however, its like starting a job and not telling them about a holiday, they only honour holiday that has been ageed at interview! |

I'm Currently Feeling: | Thanks for that spellbound, interesting read. My 15th week is next week so will be telling the OH to notify them about his paternity leave! Want it done properly this time! |
