Ordering stuff online - your rights


Hi girls,
I just saw a thread about people ordering things online & with them not being good quality, etc etc
I'm a legal advisor & I just wanted to make you all aware of a couple of things coz I know people get worried about buying clothes etc from the internet:
If you buy from the internet/over the phone then you've got rights under the Consumer Protection (Distance Selling) Regulations 2000 which states that you have 7 days from receipt of the goods to inspect them & send them back if you don't like them. They don't have to be faulty in order to do that, you can simply change your mind. You might, however, be responsible for the delivery charges.
If your goods are of a crappy quality you've got rights under the Sale of Goods Act 1979 which states that your goods should be of a satisfactory quality - if they're not then you're entitled to a repair, replacement or refund. You should not have to pay delivery charges in this case.

Just thought I'd add this because I know people get worried about sizes & not being able to look at stuff

Ah, I forgot to mention online auctions - these are not covered by the distance selling regs.
If you are buying from Ebay TRADER & use the 'buy it now' option, you have full statutory rights under the Sale of Goods Act including that your goods should be as described & a satisfactory quality. If it's a bidding war, you are only entitled that the goods should be as described.
If you are buying from a private seller on Ebay, you only have rights that the goods should be as described.
