I'm Currently Feeling: | HELP! Preggo brain has got me in trouble I renewed my car insurance in Feb and put OH as a named driver. At the time he did have a pending conviction for careless driving but when I was getting the quote they didnt ask for pending convictions, they only asked if any drivers had any convictions, so I answered no.
OH did get convicted and got some points a few weeks after I had taken the insurance out but stupid me didnt tell them. To be honest it didnt even cross my mind that I should call them, wasnt even something I thought about.
Anyway, I have now had a letter from the insurance company saying it has come to light that a named driver has points that were not declared and they are now conducting a legal investigation. WTF!!!! The letter says my insurance has not been valid since end of Feb and I must contact them within 7 days to discuss the issue. The letter isnt dated and it came through the post on saturday morning. I contacted them this morning and they have said I didnt contact them within 7 days so they are now continuing their legal investigation and in the meantime I cannot cancel or amend my policy and they will continue taking payments but my insurance is invalid!!!
OH doesnt even drive my car anymore and is younger than me so it would have been in my interest to call them if id have realised as it would have reduced my premium.
Whats happening! Help! Im worried that they are going to try and do me for fraud or something! |

I'm Currently Feeling: | It was a genuine mistake - can you not cancel the direct debit from your banks end - why should you pay for something that your not getting? Perhaps go to citizens advice - I'm not really sure what else to advise, I'm sure you won't get done for fraud though - sorry I'm not much help - I just didn't want to read and run!  |

It really was a genuine mistake, if it had massively reduced my premium to have him on it or something then I could understand it but when I got the insurance he was only 20 and its more for men anyway so it put it up a bit!
Will definitely call citizens advice, really worried though! |

Get yourself on the phone to the citizens advice, it was a genuine mistake, it's not like you're running a drug den from your front room.
They will have recorded their phone calls when you rang and got your quote, and if the operator didn't ask if your partner had any pending convictions (rightly or wrongly - it could've just been the operator didn't ask you the right questions), then it's really not your fault for telling them is it now.
The fact that the letter isn't dated is not right btw, you need to get a photo copy of this and send it to them along with a rather terse letter once you have spoken to the citizens advice bureau, stating everything you've mentioned here. Be as exactly with the detail as possible. The main thing is putting pressure on them to get it sorted... you'll be one of thousands in a data base of people they are "investigating" and it wont hurt your case to keep pushing them. They will more than likely try and fob you off with "we never received your letter" so send it signed for and then that guarantees it will get there.
Main thing is - DONT PANIC! Try and keep calm for the sake of you and the little one.
Ohhhh, something I've just thought about, if you want some advice from a solicitor as a second opinion, ring the solictors in your area and find out if they have any free advice evenings - kind of like a "first consultation free" type thing, might help you put your mind at rest!

I work for a car insurance company dealing with claims, i can help a little bit but im not clued up on the policy side of things.
I can tell you what usually happens at our company but i dont know if this is what happens with your insurance company.
If we find points on a licence, modifications on vehicle etc, that havent been disclosed, we pass the information on to our underwriting department so that they can assess if the person/vehicle we are insuring is an acceptable risk. The majority of the time the risks are acceptable and an additional premium needs to be paid which is usually backdated to the start of the policy. It can either be paid in a lump sum or added on to a direct debit and the policy carries on as normal.
If the risk is not acceptable the policy would be void from the start of the policy and any premium would be refunded.
Like i said though, i dont know if this would apply to your insurers or not, and i work in claims so im not 100% sure of the procedure! I hope i have helped a bit though!!

Hes not driven the car at all, he was only on it for convenience sake and it was a genuine oversight on my part.
Im just worried because they used the word 'legal' several times and im worried that they will try and do me for something!
I dont want anything refunded but surely they cant ask for more seeing as its now June and they have just sent me a letter saying my insurance hasnt been valid since feb!

I'm Currently Feeling: | they trying to scare you hunny, call up your bank cancel your direct debit, and like all the other ladies said ring citizens advice, if you rang them to try sort it out and they wouldnt accept it, then saying they take you to court it is logged to say u tried ringing to resolve they aint got a leg to stand on xx |

I'm Currently Feeling: | Citizens advice are useless - just called the number and it says they are only open on a thurs between 10 and 3!! Tried calling insurance too but all they say is they cant discuss the matter with me.

Like gemma said, they're just trying to scare you.
That's rubbish about not being able to talk to you, if there's not date on the letter, then how were you supposed to know when 7 days was??
They're being purposefully difficult. How about writing them a letter like I said? Then at least you've told them everything you need to say, and they can't exactly say "No thank you Mr Postman, this woman can't send us letters?"
If it carries on take it all the way up to the top of the chain till someone listens/ you get a reply.  |
