criminal law is so interesting though!! more so than the other areas !! Im just baby baby baby at the mo lol!!!

The law states that if he fails to agree with community service hours he can infact be retried for the original offence!! Not sure what the maximum is for handling stolen goods with intent but Im sure a custodial sentence has a mention!! So he doesnt want to be doing that!!

also from what I remember from uni about community service he will be given a set amount of hours that has to be completed within a certain amount of time!!! Im sure his probation officer will allow time off for his baby being born. he will just have to make it up the following week!!!
Crikey! I had no idea!!!!! Stu didn't turn up on 4 of his occasions, and had another 40 hours added on - that was all. And his brief had told hom that was all they ever did! Sorry if I mis-lead.

I think it would depend on the seriousness of the offence!! But yeah legally the defendant can be retried again for the same offence with the court knowing that his/her first punishment wasnt taken seriously!!
Its a weird and wonderful crazy law lol x

Thanks for all your replies everyone - sorry, Ive got a habit of starting a thread then not coming online for ages!!

Hes got an interview with this probation officer on the 28th so hoping he gets a nice one! Apparently they'll make a decision on his sentance depending on how he comes across at this interview, if he appears to be a danger to society ( ) or likely to reoffend then he'll get a bigger sentance. A friend of my mums is in the police and he seems to think that he would get time off in the unlikely event i went into labour while he was doing it.

And yes - unbeknown to me the solicitor guy did give us the worst case scenario so he may not even be required to do the work yet, and he is working full time so im pleased to hear its only 7 hours a week he'd need to do!

Thanks again for all your advice everyone, i will keep you all updated and let you know what the outcome is! Fingers crossed its not too bad!
