can you get discilplined for being off sick at work


Hi

I have been signed off work (again!) as am spotting,am 10 weeks pregnant.

My question is can you get into discilplinary procedure? My company of you are off more than 2x in one year you go down a route of warnings etc,etc as we get full sick pay........

Well i was off work 3 weeks ago for 2 weeks so wondered as am worried cause I cant work now, the other absense was also pregnancy related and was my third absense in one year (2 others not related were months ago)

The reason I am off today is work made me stand up and do a 2 persons job last night for 4 hors and i started spotting,the manager has said I will be given a sit down job and he was cross this had happened but my midwife is saying No way you can stay off work until my scan (next friday)

What do you think?

Hunny, if you have a sick note and it is pregnancy related there is not a damn thing hey can do.

and at the end of the day they should be doing a risk assesment for you to see if everything in the job is in noway harmful to you ar baby

it is you standing up and doing 2 peoples jobs that may have caused this to happen, remember you do not have to do anything that is not written in your contract

If they did try discipline Eg: final warning and you are out they wouldn't have a leg to stand on in court

Make sure you get loads of rest and try not to worry and do not go back to work until you feel ok to

I'm sorry to hear your spotting Bexxie, make sure you post us a piccie next friday. I'm sure everythings fine [-o<

My dad had a hernia op last december and had to have a few weeks off because he couldn't walk properly (he's bin man) and when he came back they all had to sign a document (which typical dad, he never read) and it states that anyone taking excessive time off sick will be disciplined.

He was given a warning, even though he was off sick before this new part of the contract came into force

So I think they can give you warnings etc but I'm pretty sure they can't give you a final warning and sack you whilst your pregnant. Especially as Jo says you should have a risk assessment done which would show that you need a job sitting down. If they were to sack you that would be classed as them being unreasonable and against the HMRC rules for employers and pregnancy and you would have a claim without a doubt.

I hope everything goes ok, but try not to worry and relax for bubbas sake *hugs*

thanks girls

I work in an engineering factory,I just needed to get that clarified as two weeks ago when i went back normally they would have jumped on my back straight away and as they never I assumed that it must be right about the pregnancy law.....are there any websites out there i can find out from...


They will give me asit down job but the hassel form the other workers (coz they will then have to stand) is crap and the MW said the emotional aspect could be worse for me it is bitchy in factories at the best of times,I hate it there anyway. Normally i am as hard as the next one but not whilst PG. Thanks a lot it is much appreciated.

Spoke to the nurse today at the factory (they have their own) and she said they can do nothing if you are off with pregnancy illness or ailment.

I keep thinking the worst,this scan i am dreading as think something is amisss,call it intuition,I have funny feeling,all pregnancy symptoms gone so am panicking a bit but common sense tells me it is because the placenta is taking over now but you know?

Hi Bexxie,

If you work in a factory is there no Union representation?

If so are you a member?

Even if you aren't and there is a Union they may advise you on your rights, which may help you chill about what they will/won't do.

The nurse at work should advise HR as to the risks and your need to change roles whilst PG. You should ask her to copy you on all communications with HR either by letter or by e-mail.
