Just some advice. When you are making a homeless application, a council cannot decide you are not priority is you do not have a local connection. If you have no local connection, then they need to do what is called a section 198 (this refers to section 198 in the Housing Act 1996, part VII) referral to the council where you do have a connection. I read you are from Germany. You would be eligible as long as you fit under certain guidelines. I have no idea how long you have been here. However, since your OH is from the UK and I assume he has been living here for the whole time, he would be eligible. You as his partner has been living with him and expected to reside with him.

If you apply for housing via the housing register, they will look at how many people are in the household and whether you are overcrowded. If you are what is considered to be statutorily overcrowded, you may be able to make a homeless application.

Did I read it right that there is you, your OH and a baby in one bedroom and his twin brother in the other?

Thanks for the info, this is what the council said they would do for us. We are not applying with our local council though, which is why the other council couldn't help, only refer us..

You can apply under homelessness if your brother-in-law is asking you to leave or you can find out from the housing register if they would consider you to be overcrowded and apply as homeless under that.
