Landlord issues.


Well tomorrow is moving day. It's happened really quickly but we are giving one months notice to our landlord as agreed.

I'm quite worried he's going to be difficult about returning our deposit though.

It's a brand new flat and we are the first people living here so it was perfect when we moved in. It still is in great condition but there are a few problems:
  • The paint has been marked in places, especially by the front door.
  • Theres a couple of really tiny dents in the walls where a chair has been pushed up too close.
  • There is a small mark on the carpet which wont come out (no bigger than a 5p).
  • There is a mark on the kitchen floor under where the washing machine goes (again no bigger than a 5p).
  • The cooker looks used (stainless steel is scratched).
  • The stainless steel of the sink also is scratched.

I read that they can't keep the deposit for what would be classed as general wear and tear and I don't know if this is?

I know they're also meant to keep it in a deposit protection scheme but that they haven't.

What do I do if they get difficult?

I am having landlord issues too - I am due to move at the end of April and I knew my landlord would hold on to my £1k deposit so I did some research.

Since April 2007 - all deposits must be held in a deposit scheme. did you move in prior to this? If not then you should have been notified of the scheme with which he is holding your deposit. If it is in a scheme, then he cannot deduct money without your agreement and if you do not agree, you will both have to discuss it in a meeting with a mediator who will decide for you.

If you moved in after April 2007 and you are not aware of any scheme, you are automatically entitled to three times your deposit back for his failure to put it in a scheme.

Regardless of when you moved in, a landlord cannot deduct money from your deposit for reasonable wear and tear - according to statutory law, but this should be mentioned within your tenancy agreement. I certainly don't think you have anything to worry about. If he did unreasonably take your money, it is very easy to fight it

If you need any more advice let me know. I am somewhat a bit of an expert cus I am no way letting my landlord rip me off!!
