Bloody Solicitors!!!


Just had a call from the estate agent through whom we're buying our house, she says to me 'I'm just calling to see how the move is going and how things are progressing?'

me 'Oh, well we're just awaiting on something from the sellers as far as I can see online which was updated by the solicitors yesterday!'

Agent: 'Well I've just had a call from Mr & Mrs (people we're buying the house off!) to say their all packed up ready to move but they are waiting on you? They were just curious to see how you were getting on as they are living out of boxes and wanted to move before easter wknd!?

WTF???

I've been trying to get hold of the solicitor but she's 'away to lunch' or 'She's on another call!' I know if I leave her a msg she won't get back to me until about 5pm!

The solicitor said to me a few weeks ago 'I'll give you a call to let you know when to hand your notice in and with an exchange date!' Then when I noticed the update yesterday I assumed she was waiting for the sellers contract or something!
So now we're going to have to pay even more rent and prob our first and second mortgage repayment aswell!!

£1000 for solicitors fee's and they can't even keep you up to date properly.......When I do get in touch with her she's getting a mouthfull!

Thats it!!!

I don't know one person who's had an easy ride with their solicitors when buying a house - it's an absolute joke especially when you consider how much money they make.

We bought the house we were renting. We had no chain, seller had no chain and yet it still took 4 and a half months for the sale to go through - WTF

It took OH losing his temper with our solicitor (which he never usually does) and surprise surprise our contracts were exchanged within the week!!

Hope you get it all sorted soon!!

ugh DF's parents moved from their 3bed house to a 2bed bungalow last year and had so much trouble.

The estate agent initially told them that they had until end of June to move. They would be staying with DF's sister for 3 weeks until their bungalow was ready.
Then they got a call from the EA saying the buyer had been waiting for them to move and they had to be out by Friday (this was latter half of May). DF's mum said not possible, but they could manage a week on Friday.
So they got all sorted and turns out the EA was playing them all off against each other. The buyer was happy to wait until end of June and the EA had been hassling him for a fee - which should never even go to the EA but to the solicitor.

So try and get things cleared between the EA and solicitor before you get in a panic because it could well be the EA just trying to chivvy things along for their commission.

hi there,

i actually do all the legal work for estate agents re the house moving process and id definately be pointing part of your finger at the estate agent..they have a duty to their client to provide the service they are paying for, they should be the ones chasing the vendors and purchasers solicitor to check that all stages rae covered and are moving at the correct pace for all parties...they are called contract chasers or sales progressors, they should be the ones that hurry the solicitors up and point out to people when things are needed to be done and when they are behind etc... this is all part of their so called service they are meant to provide!
With solicitors its a total luck of the drawer I think some are fabulous and worth their weight in gold where as others are more trouble than they are worth, sometimes it can work if you arrange to go around to the property you are buying and exchange phone numbers with the sellers and talk directly to them I find you can sometimes get more sense than with the sols or the agent...one little tip however is the solicitors tend to respond more to the written word so if you have access to a fax machine then fax them giving them times you need contact by and say if the solicitor themself cant contact you you expect them to be able to relay the information you are waiting for to their secretary or assistant and they can call you!

Well....
I got hold of my solicitor and she told me that the hold up was due to an issue regarding a small parking and grass area which is in front of our garden. The solicitor needed to know who owned and looked after the areas, it wasn't the council and they don't know who is responsible for it. The solicitor said she wouldn't complete as technically there was no "legal" access to our property (even though there's a path which is owned by the council) and also if someone was to have an accident they needed to know who owned it for legal reasons!

Anyway as we could find out who owned it she said we'd have to have a special document (forgotten the name) to basically say they sellars have never been responsible for it and that we will never be responsible for it. The sellars have agreed to pay for it which is fab as otherwise we would have had to pay!

The sellars are wanting to be out by the end of the month which hopefully means we will be in during the first couple of weeks in april!

land disputes can be a nightmare and very lengthy in process, your solicitor however is doing the right thing to protect you when you move in and if an indemnity has been raised youl be fine, nice to see things coming to the end or the start of a new life/home i should say!!
