Any advice?!


My SIL has just rung me to ask which housing i am with, apparently the landlord she is privately renting off has given her, my brother and their 2 children til the 2nd Jan to move out!!
I don't know the situation, but i know they are not the ones to not pay rent!!

Right through christmas time to, my housing association is soooooo hard to get on the list for and the council are not much better!!

I didn't know what to say, there is no room for them to stay here and the hostels round her ar disgusting!
My poor nephews! they are 5 & 9 yrs and i can't see any of them staying in a hostel.

No one they know has room!

as long as she has been given 8 weeks notice and it is the end of her contract and the landlord does not want to renew the contrat then they are not breaking any rules.

she needs to go to the council with her proof of being made homless and they will pu her to the top of the list, they will offer her the first sutible propety but if she refuses it then they will put her to the bottom of the list.

i was in this situation the 3 bed flat i was offered was like some thing out of "life of grime" i refused it then the council would not help me any more so i private rent again.

sshe should get her deposit back when she moves out and could then use it for a new place?

Dionne, i didn't want to ask too many questions they are a very private family and only tell you what they have to

The only thing i can think of is that they cannot afford to privately rent again, i don't know why they are looking for council, it is definately the cheaper option.

Right Firstly go to a local solicitor, Most solicitors will give them an initial Half Hour consultation for FREE. Find out your right's and also the Homeless Process in your Area. Don't worry about actually hiring one yet.
If you cannot find a solicitor in your area that does this FREE Service go to the local Citizens Advice Beureu. You can be a sitting tennent for up to 3 months :wink:

The Landlord has to serve them with a Notice to Quit<< The Date on this Notice to Quit of the eviction itself must be dated exactly 1 month or more after the date they recieve it. They will also need to sign this and get one copy for themselves and one copy to send back for the landlord. I personally had mine dated for the 1st of April but didn't sign it till the 2nd which made it void :wink:

Take the Notice to Quit to the local Authority and speak to a Homeless Housing Officer (here they will Need to plead their case) The Homeless Housing Officer will Appoint a Solicitor for you if you cannot afford one of your own. \/

The process is long winded and will Involve a court date for a Judge to declare you as Evicted but once your Sister in Law gets that eviction Notice they then become legally homeless and can be housed by your local Authority.

The Local Authority can keep you homeless for up to 4 months but it isnt that bad. I got the Council to pay for storage for me (this will help speed up the process as it costs them more) I was put into a very nice Bed and Breakfast for 4 weeks which also cost them a fortune Twas nice not to have to worry bout brekkie though.

I was then moved in to a grotty Hostel which i then only stayed in for one night and then I moved into my sisters I was there 4 weeks (Overcrowded) Before the Council gave me a three Bedroomed House/Flat. I have now been here nearly 2 years

My Eviction went from 1st April to November in the end so please comfort your Sisterin Law tell her to get the appropriate Advice and there is no need for her to worry about being kicked out so soon in the new year.

ild love a council house. there are none round here. i pay £620 a month rent
but all the asilum seekers are getting them. a girl on mat leave earning £100 a week with 2 babies aint a priority!

Thanks for that advice tootsie i will pass itmon!!

Dionne, we got to the point when i went on maternity leave and renting a private house, we couldn't afford to pay the rent and HAD to leave as it was making us skint and with Amy in tow and Jack on the way i didn't want no finances.

We went to the homeless office and she said as long as we have £70 a month spare to buy food then its enough to llive on!!!!
What about clothes petrol to get to work to earn the money etc!!

We had been on the housing list 3.5 yrs before we got this house

Trust me they will go through many ups and downs but eventually it will all be sorted as Dionne said though they will have to accept the first house they are given but tbh it's better than nothing and alot more stable than renting. Eventually they can move on or better still transfer.

I live up three flights of stairs and Wobbles will tell you they are a nightmare, but my estate is being regenarated soon and families get new houses :wink: roumored to be gardens for us too So fingers crossed the housing association actually put their money where their mouth is

I work for the Council-Housing Dept, Dale used to be a Homeless Officer before he joined me in antisocial behaviour.

You have to be careful-if the housing stock is low in their area, they will be offered temp accomodation, this van either be a furnished property or a shitty b&b, the clause is, if one of them works they have to foot the bill for the B&B and sometime you are cheaper booking into a travel lodge!

They can keep you in temp for up to 28weeks, so if they are needing a house by January and want to avoid temp, tell them to get to the local housing office and present themselves as homeless, with proof from the landlord that he/she is wanting them out. Can I add the Council has no obligation to house 2 parent families urgently, so they will not necessarily be put to the top of the list for a house. All the "urgent medical" get top priority which is wrong
