I'm Currently Feeling: | Help!!! Does Anyone Work In Hr?? ok, so im leaving work on ill health and my HR manager sent me an email about severance pay, this is what she put... The only severance pay would be is 1 full months pay with any additional annual leave that you will have accrued as you have only been with us for a short while. We pay staff that finish on incapacity 1 months pay for each year they have worked for us to a maximum of 12 years.
Sooo...ive worked for them for 3 years, does that mean i get 3 months pay or, just 1 like she first writes?

Isnt incapity less than your full pay anyway.
So its your getting one months full and your holidays (because there full) then 3 months incapity at a lower rate for how many months your entitled to....and then it moves on to the goverment paying for you but your job has to stay open for when your able to return.
Im kinda sure thats how it works if i can remember correctly but im in finance now and have been for 4 years (worked in personnel for a few months 4 years ago :doh  but im not 100% Sorry couldnt help more XxxX |

I'm Currently Feeling: | my contract is being terminated on ill health grounds, which im happy with, it was originally being kept open but i wanted, and they did, to terminate it. |

I'm Currently Feeling: | Ok well it should work the same. Legally they have to pay you incapity for how long your entitled to because of it being ill health. Then it tranfers onto the goverment Incapity Same amount just diff person paying you. Weather they will give you as a lump sum or over the months im not sure that depends on the company.
just be aware, I only know this cause my OH was off work for a year a few years ago. Once your Work stop paying you incapity you have to submit a claim from the job centre. Straight forward.....hell no. And it took a few weeks for my OH to get any money. Now this was 2 years ago. so they might be better but a word of advice, save as much money as you can from what your work gives you to see you through  And if they give you a lump sum you cannot complete you claim until your not been paid...I.e you get paid till the 20th dec....but get a lump sum of the 20th of september. and you want to make a claim you cant until the 20th of dec. So make sure you dont blow it all lol

I'm Currently Feeling: | Her email makes no sense. She says you'll be paid 1 month's salary, then she basically says that you are entitled to 3. I would check your contract as the terms might be specific to the company, but I'm sure she wouldn't mind you questioning what she's written and reminding her that the 'short while' you've been there is actually 3 years x |

Havent heard anything back yet.
I work for the NHS and we have mutually agreed that my contract be terminated on ill health grounds.

I'm Currently Feeling: | Have they given you a compromise agreement for you to sign and agreed a settlement figure then?
That is what I would expect to happen in this situation. They pay you off because they don't want to go through the hassle of dismissing you and you sign an agreement saying you won't claim unfair dismissal. It's also common practice for them to agree a standard wording for a reference if anyone requests one. |
