Anybody work in HR?


I need some advice. I think I am being treated unfairly and wanted an opinion to see if I have case to put to my employer.
Any of you work in HR?

Here is the full story. I am being made redundant (my fixed-term contract is ending). But according to the law, my employer has to try and find me another job. I had a meeting with HR a while back where they said everything would be done to keep me if they could. Now, somebody has announced she is preganant. I am more than qualified for her job. but the job has been informally offered to someone else (outside of the company) . so they tell me I can't have it. Is that even legal? Can they offer to soeone without advertising?

Hi Helen

No, I am not PG. we are trying but not successfully so far. but that shouldn't affect the job issue as nobody knows we are trying.

Do you know if maternity covers have to be advertised? It is for just over 6 months.

Pregnancy/maternity leave gives you additional rights under UK law in a redundancy situation hence that question.

Employers aren't required by law to advertise positions so they've done nothing wrong there per se. However, it doesn't sound right that they overlooked you in favour of another person from outside the company when you are under your redundancy consultation period. You should have been advised of the position as it's up to the employee to determine whether it is suitable alternative employment.

When does she go on leave? I take it that it's soon?

My advice would be to raise a formal grievance with your employers about what has happened. They can't go back now on their offer to this other person but it may be worth following through to see if they make you an additional payment under a compromise agreement.
