Maternity pay?


Hi girlies,

I'm starting a new job in mind June, and if i was to get pregnant between now and then, going into a new job pregnant, probably wouldn't be a good idea .. would i still be entitled to maternity pay, or any other pay? I'm a little worried they may sack me ..

Well they can't sack you. I just wouldn't tell them till you've been there for a while and have to. If you can't get maternity pay from them, which I don't think you'd be able to if you were pregnant before going to work there then you'd still be able to get it from the government.

They can't sack you jsut for being pregnant, if they do it's classed as Unfair Dismissal. You qualify for SMP if you have been working for your employer at least 26 weeks before the baby is due I think I had a link somewhere about it all, I'll just go find it for you

Also they cannot ask you at interview if you are pregnant or TCC so I'd keep it to yourself until you've been there a while. I was under the impression you had to be employed for 26 weeks proior too. Lots of luck to you xXx

hi ya

im going through a lot of stressful things at the moment with my employer so i have had to seek legal advice...heres the situation in the uk...

you have to have worked for your employer for 26 weeks at the beginning of the 15th week your baby is due....what ever day your baby is due you take it to the sun b4 the due date...

for example i was empoyed on 26th october and i have to be continuously employed by my employer by today and part of this coming week (which will mean as long as im employed by them tomorrow i will qualify for smp) this is 90% of your average earnings for 6 weeks then 33 weeks at £117.18 or 90% of your average pay which ever is LOWER!! The way they calculate your average earnings is on inland revenue smp calculator...

if you havent been employed by your employer for the required time then you will qualify for ma (maternity allowance) which is the same basic format but the length of the benefit will depend on your personal circumstances....

ALSO please be aware that the law states if you have not been employed in your current role for 12 months then you do not have any employment rights...as in you are not allowed to claim unfair dismissal unless it is due to racial, disability or sexual discrimination....also if they make you redundant because they say they no longer need you and then take on somebody else for you position (they are allowed to do this unless you can prove youve been made redundant for the reasons stated above) this is only the case if you have only been employed for less than 12 months though...

Hi I was also wondering about this... I have been working for 5 months but its only temping, i'm hopeing to be taken on perm in May but if i'm not taken on perm & do go to another temp job or stay where i am temping for longer, and do fall pregnant what am i entilted to?
