Anyone know anything about rental agreements (housing)


So I wrote our landlord today as our lease is up end of the month and we plan to move out unless we can't find something by then and then we will do month to month until we can. So I told her that and asked how much our rent would be if we did month to month. This is the response she sent

"You can go month to month until you find another property. As stated in
your lease agreement, you must give a 45 day notice to vacate. The rent
for February will remain the same. The increase in rent to go month to
month is $200.00.

However, we can extend your lease for three months and keep the rent the
same. Keep in mind, you need to provide a 45 day notice to vacate no
matter what option you take."


Ok so I'm a little confused by this. Is she saying no matter what we have to pay Feb rent, the normal amount we pay???? Because we signed a lease that holds us in until Jan 31st. They can't require us to pay Feb too just because we haven't given 45 days correct?? I've lived in apartments that have had a certain amount of days thing but when the end of the lease came it didn't really matter at that point, it was more if you were moving out early

Not sure as it's a private owner you are leasing from I assume?

With big management companies if you don't renew your lease by the time your year is up they typically assume you are going to go I think...

But then with memberships to gyms etc even if you sign on for a 1-year contract they keep charging you past the 1 year (and you still get the services) if you don't cancel and give 60 days.

See we always had "give 60 days notice" or "give 45 days notice" but it never applied to when the end of our lease was. Like we had to give 60 days at our last place, we told them very beginning of Jan we were moving at the end of our lease, which was the end of Jan and that was fine, the 60 days was more for if we decided to leave early we had to give them that 60 days notice before leaving....or we'd be charged like crazy. So I thought this was the same thing? I thought if we signed a lease from Jan 09-Jan 10 that they couldn't hold us to anything after the end of Jan?

hmmm im not to sure did you read your agreement?? alot of the times they have every detail in there.....

Oh but it's a company we are leasing from, not the actual owners.

I'm going to be really annoyed if we have to pay for Feb too, we had held off with Mark driving 75mi each way to finish out our lease in Jan to move closer to his work, since we have tons of stuff and all of the deposits and all we didn't want to have to pay to get out of our current lease. Well by paying Feb rent we might as well done that and saved $500 a month in gas these past couple of months

Plus this company has been awful, the only thing they are good at is repairing things. But there is an HOA here, as stated in the lease they are responsible for the HOA dues BUT when we didn't get our pool key...this neighborhood has tons of amenities such as a pool and parks, but you have to have keys....I called them and they said the owners are responsible for the HOA dues. So they contacted them, supposedly, and said it would be taken care of. I called them first time in March before the pool opened, it was open until Sept and we never got the pool keys and our houses HOA dues are STILL not paid. I called many times too. They blamed the owners but our lease didn't say the owners responsible but them. So we went without those amenities which were the big reason we leased here for the kids and now we are still going to get screwed in the end and have to pay more. I mean I understand if I signed it and thats how it's written it's my fault, I messed up, I just think it's really crappy. With the holidays and all we really didn't think of it and it's not THAT late....just sucks

That really does suck hun!! sounds like you for sure need to move, how much is your damage deposit there?

We put down $1000, our rent is $1025...but they always seem to find something to spend it on. With having toddlers here I know they will need to repaint, but other than that everything is fine in the house. They have to clean the carpets, they aren't bad but that's required by law between tenants and there are just a couple spots that def will come up with a cleaning

wow thats alot up here damage deposit is not allowed to be more that half of your rent thats crazy!!!! so are you thinking you might not get it back anyways? cuz they could just use that as your rent/fix the paint and tell them to shove it lol

That's what I want to tell them lol. Surely to do one coat over the inside of the house wouldn't be close to $1000 so they would still have alot of that left. I mean really we haven't found another place yet, we've been looking and there isn't much available where we need it, we found one house and the day we turned in our app it was leased right before they got ours So I mean it's possible we would be here in Feb...so it would be nice to only pay $1025 instead of $1225, but IF we find something I don't want to give them another penny. They never could get the HOA dues paid after me calling so much. She kept saying I'll get it taken care of and call you back, I called back so many times, then when it was almost time for the pool to close for the year I just gave up and never heard another word from her until I had to call out our toilet being messed up...even then she didn't mention it. Really crappy for a business you know? Oh well, guess we'll see what happens with finding a new place
