what are my rights?


i cancelled my direct debit for my gym, as i was paying for summin i wasnt using, now in my "agreement" it says i have to be a member for a year b4 i can quit...(which i wasnt lol)

however, checking my online banking today i seena payment of £19.95 coming out as a switch transaction... now i think they have taken the money off me! cos if they looked on system and put it through it would come off switch ? i think?

if it is them(im sure it is!!!) surely they cant do this when i have cancelled DD!!!!!

That is breaking the law and you can get a transaction form from your bank as they have illegially taken money from you with out permission.

I really hope you get this sorted. Is it a big company? They can be really annoying with things like this, but hopefully your bank will be on your side.

I would say though, if you signed a contract with them and you have a copy (which I think legally you should have), read it carefully. If you signed a contract saying you'd pay £X for Ymonths, then you owe them the full sum. Nice companies have an early cancelation fee which is less than the full contract is worth. The only contract I have is with my landlord, and that has early cancelation terms.

I'm no legal expert though. Have you tried talking to the gym?
